These general terms (“Terms”) (together with the documents mentioned herein) establish the conditions that govern the use of the web store haicolours.com (“Online Shop”), the purchase of products on the Online Shop and the commercial relationship between you and Berner Oy (“Berner”, “us”, “our” or “we”). The Terms shall apply to all of your activities on Online Shop regardless of the device you use for browsing the Online Shop.

These Terms and the documents referred to in these Terms set out the rights and responsibilities of you and us with respect to online shopping. By using the Online Shop, you confirm that you have acquainted yourself with the Terms in force at any given time and undertake to abide by them.
2. Service Provider’s Rights and Obligations

5. Limitation of liability
To the extent permitted by applicable mandatory legislation, we shall not be liable for any economic losses, loss of income, loss of profits, loss of contracts, business or anticipated savings, loss of goodwill, or reputation or special or punitive losses, nor any consequential or other indirect damage. This liability exclusion does not apply in cases of gross negligence or unlawful intent and does not apply to the liability of the seller for death or personal injury caused by the goods to any person.
We make reasonable effort to accurately display the products in the Online Shop, including composition and colours. The colour variations between the images and the actual products may depend on your computer settings, internet browser or other matters, and we cannot be held liable for differences between the images and the actual products.
6. Applicable Law and Dispute Resolution
The legislation applied to these Terms shall be determined in accordance with applicable mandatory legislation. Unless otherwise stipulated by applicable mandatory legislation, these Terms shall be governed by and construed in accordance with the laws of Finland.
Any disputes arising out of or relating to these general terms, the Online Shop or purchases made in the Online Shop shall be primarily settled by negotiations and finally by a competent court as determined by applicable mandatory legislation.
You have the right to bring legal action in the general court of first instance within the jurisdiction of which you have your place of residence or habitual residence in Finland. You may also submit the matter to the Finnish Consumer Disputes Board (www.kuluttajariita.fi). You may also bring a dispute related to the Terms or the Online Shop to dispute resolution through online dispute resolution maintained by the European Commission (http://ec.europa.eu/odr).
Nothing in this section shall affect the rights you have, as recognised in any applicable consumer legislation in effect.
7. Amendments to the Online Shop and the Terms
We reserve the right to amend these Terms at our discretion. Any changes to the Terms shall enter into force two (2) weeks after such notification has been made.
